Terms of Service

1. Agreement to terms

By using EstateAgently ("the Platform"), you agree to be bound by these Terms. The Platform is operated by Velliers & Hart Property (PPRA registration A12345670, VAT 4080291557), a registered South African property practice.

2. Property practitioner obligations

Users acting in a property practitioner capacity warrant that they hold a valid Fidelity Fund Certificate (FFC) issued by the PPRA at the time of any regulated activity. The Platform may suspend access to listings, offers and commission features when an FFC lapses, in line with the Property Practitioners Act.

3. Trust account

All trust receipts and disbursements processed through the Platform are subject to the Property Practitioners Act's trust account rules, including daily reconciliation and annual Section 54 audit.

4. Acceptable use

You may not use the Platform to send unsolicited communications outside the POPIA-compliant consent framework, to misrepresent property condition or pricing, or to bypass the disclosure obligations of the Property Practitioners Act.

5. Termination

We may terminate or suspend your access at any time for breach of these Terms, including compliance breaches that endanger the trust account or the Platform's regulatory standing.

6. Governing law

These Terms are governed by the laws of the Republic of South Africa. Any dispute will be heard in the High Court of South Africa, Gauteng Local Division, Johannesburg.
